(End User License Agreement)

Welcome to All Your Senses! We are very glad to have you as a Customer. These Terms of Service (the "Terms"), together with our Privacy Policy, form a legally binding agreement (also serving as an End User License Agreement, or EULA) between you ("Customer") and All Your Senses.AI, Inc. ("Company," "we," "us," or "our"), a corporation incorporated in Delaware and headquartered in Washington, D.C. These Terms govern your access to and use of the All Your Senses mobile application (the "App") and all related services (collectively, the "Service"), whether accessed through iOS, Android, or our website. By downloading, installing, creating an account, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service.
All Your Senses is made for adults. To access the Service you must be 18 years of age or older (or the age of legal majority in your jurisdiction, if higher). During registration, you will be asked to enter your date of birth. This is how we verify that you meet our minimum age requirement. By using the Service, you represent and warrant that you are at least 18 years old and that accessing our content is lawful in your jurisdiction. If you are under 18, this Service is not for you — sorry! Please exit the App. If you provide a false date of birth, you bear full legal and personal responsibility for that misrepresentation. We accept no liability arising from false age declarations. We reserve the right to suspend or terminate any account where we have reason to believe the minimum age requirement has not been met.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a personal device you own or control, solely for your personal, non-commercial enjoyment. You may not: • Copy, modify, adapt, translate, distribute, sublicense, or create derivative works based on the App or its content. • Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App. • Use the Service to generate, upload, transmit, or distribute any content that: involves minors in any sexual or suggestive context; depicts or glorifies non-consensual acts; is threatening, harassing, or incites violence; involves harm to animals; or is otherwise unlawful under applicable law. • Circumvent, disable, or interfere with security features, access controls, or subscription restrictions of the Service. • Use the Service for any commercial purpose or in any way that is not expressly permitted by these Terms.
To access the full features of the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Accounts are personal and may not be sold, transferred, shared, or used by more than one individual. You may browse limited features of the App without registration. Account creation is required for story generation, saving preferences, and managing subscriptions. You agree to notify us immediately at contact@allyoursenses.ai if you become aware of any unauthorized use of your account.
The Service operates on a subscription model using a credit system. Credits are redeemed to generate stories of different lengths: • 1 credit = Short Story • 2 credits = Medium Story • 3 credits = Long Story Subscription Plans The following plans are available (prices may vary by country or region): • Regular: 8 credits per month. Annual plan available at approximately 30% discount. • Premium: 12 credits per month. Annual plan available at approximately 30% discount. Free Trial New Customers may be offered a free trial period of seven (7) days, during which 3 credits are available for use. The following conditions apply: • Free trial credits are provided for you to experience the Service. They do not represent the full credit allocation of any paid plan. • If you do not cancel before the free trial ends, your plan will automatically convert to a paid subscription. • Upon conversion, your full plan credits will be issued for that billing period. • Credits used during the free trial are not reimbursed or carried over. • Free trials are available to new Customers only and may not be combined with promotional offers. 4a. iOS Customers (Apple In-App Purchase) • Payment is charged to your Apple ID account at confirmation of purchase. • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. • To manage or cancel: go to Settings > [Your Name] > Subscriptions on your device. • Apple manages all billing and refund requests for iOS purchases. 4b. Android Customers (Google Play / Stripe) • Payment is processed securely through Stripe via our website checkout. • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. • To manage or cancel: go to your Account Settings within the App, or contact us at contact@allyoursenses.ai. • Refund requests for Android purchases are subject to Stripe's payment terms. General Payment Terms • Credits do not expire and accumulate in your account for as long as your subscription remains active. • Credits accumulated under any plan are retained if you change to a different subscription tier. • No refunds will be issued for unused credits or remaining subscription time, except where required by applicable law. • We reserve the right to change subscription pricing with reasonable advance notice. If you reinstall the App or switch to a new iOS device, you can restore your previously purchased subscription by tapping "Restore Purchases" on the App's subscription screen. This ensures that Customers who have already paid through Apple are not charged again for access they are entitled to.
Our Content All content available through the Service — including AI-generated stories, audio recordings, sound effects, background music, images, software, user interface design, trademarks, and all others — is the property of All Your Senses.AI, Inc. or its licensors, and is protected by applicable copyright, trademark, and intellectual property laws. Nothing in these Terms transfers any ownership of our intellectual property to you. Your License to Use Content We grant you a personal, non-exclusive, non-transferable, revocable license to access and enjoy AI-generated stories and audio content through the Service, subject to the following conditions: • Content is licensed for your personal enjoyment only, within the App. • You may not download, reproduce, distribute, publicly perform, broadcast, or transmit any content from the Service. • You may not use any content from the Service for commercial purposes, advertising, or any purpose other than private personal enjoyment, except where All Your Senses explicitly authorizes otherwise through a specific promotional campaign or challenge. AI-Generated Content Stories generated through the Service are produced using artificial intelligence. Consistent with current legal frameworks — including guidance from the U.S. Copyright Office — AI-generated content may have limited or no independent copyright protection. All Your Senses.AI, Inc. asserts ownership of AI-generated output produced through its platform to the fullest extent permitted by applicable law.
You agree to use the Service in a lawful and respectful manner. The following are strictly prohibited: • Generating, requesting, or attempting to generate any content that depicts, involves, or is directed at minors in a sexual or suggestive context. • Generating content that depicts or glorifies non-consensual sexual acts or sexual violence. • Generating content involving harm, abuse, or sexual acts involving animals. • Using the Service to harass, threaten, or harm any individual or group. • Attempting to manipulate, bypass, or exploit the credit system, free trial, or subscription limits. • Using automated tools, bots, or scripts to access or interact with the Service. • Any use of the Service that violates applicable local, national, or international law. We reserve the right to investigate suspected violations and to suspend or permanently terminate any account found to be in violation of these Terms, without notice and without refund.
All Your Senses offers a referral program that allows existing Customers to earn credits by referring new Customers to the Service. Participation in the referral program is subject to the Referral Program Terms, available at: allyoursenses.ai/referral-program We reserve the right to modify or discontinue the referral program at any time, with or without notice. Referral credits have no cash value and may not be exchanged, transferred, or redeemed outside of the Service.
Your privacy matters to us. The collection, use, and protection of your personal data is governed by our Privacy Policy, which forms part of these Terms and is incorporated by reference. We use third-party AI and technology providers to power the Service, including for story generation and audio production. We do not share any personally identifiable Customer information with these providers. Story generation inputs are processed to produce output and are not used to identify you. The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that the AI-generated content will meet your expectations or be suitable for any particular purpose. The Service and all content available through it are provided for entertainment and personal enjoyment purposes only. Nothing in the Service constitutes or should be construed as professional advice of any kind, including medical, psychological, therapeutic, or relationship advice.
To the fullest extent permitted by applicable law: • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service. • Our total aggregate liability for any claim arising out of or related to these Terms or the Service shall not exceed the total amount paid by you for your subscription in the twelve (12) months preceding the date of the claim. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such cases, our liability will be limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless All Your Senses.AI, Inc. and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: • Your access to or use of the Service. • Your violation of these Terms. • Your misrepresentation of your age or eligibility. • Any content you submit or actions you take through the Service.
We may suspend or terminate your account and access to the Service at any time, with or without notice, for conduct that we determine — in our sole discretion — violates these Terms or is otherwise harmful. You may terminate your account at any time by canceling your subscription through your Apple ID settings (iOS), your App account settings (Android), or by contacting us at contact@allyoursenses.ai. Upon termination, your license to use the Service is immediately revoked. Unused credits accumulated in your account are forfeited and are non-refundable, except as required by law. Sections 6 (Intellectual Property), 9 (Data & Privacy), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law), and 15 (Dispute Resolution) survive termination.
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Customers located in the European Union or other jurisdictions with mandatory consumer protection laws retain any rights granted to them under those laws, which are not affected by this choice of law clause.
We encourage Customers to contact us first at contact@allyoursenses.ai to resolve any concerns informally before initiating formal proceedings. For Customers in the United States: Any dispute that cannot be resolved informally shall be submitted to binding arbitration in Delaware, in accordance with the rules of the American Arbitration Association (AAA). Class action lawsuits and class-wide arbitration are expressly waived. For Customers in the European Union: Nothing in these Terms prevents you from bringing a claim before the courts of your country of residence or before an applicable consumer dispute resolution body. For Customers in other jurisdictions: Disputes shall be resolved in accordance with the laws of Delaware, unless local mandatory law provides otherwise.
We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you via the App or by email (if provided) and update the "Last Updated" date at the top of this document. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and cancel your subscription.

These Terms of Service apply to both the All Your Senses mobile application (iOS and Android) and the All Your Senses website. They are intended to serve as the End User License Agreement (EULA) required by the Apple App Store and Google Play Store.
